Scope and acceptance

These terms apply to all visitors, shoppers, account holders, referral participants, and other users of the public Crestpal platform, including browsing, account registration, cart activity, quote requests, checkout, payment, store pickup, delivery, support communications, and use of related pages or tools.

If you do not agree to these terms, do not use the site or place an order. If you use Crestpal on behalf of a company, school, team, or other organization, you represent that you have authority to bind that organization to these terms.

Eligibility and permitted use

You may use Crestpal only for lawful purposes and only if you are legally capable of entering into a binding contract under applicable law. If you are under the age of majority in your jurisdiction, you may use Crestpal only with the involvement and supervision of a parent or legal guardian.

We may refuse service, suspend access, cancel orders, or restrict features where we reasonably believe a user is violating these terms, misusing the platform, creating risk for Crestpal, or engaging in fraud, abuse, or unlawful activity.

Accounts, credentials, and account security

Some features require an account. You agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for all activity that occurs under your account unless caused by Crestpal's own breach of duty.

You must promptly notify Crestpal if you suspect unauthorized access, credential compromise, or misuse of your account. Crestpal is not responsible for losses arising from your failure to safeguard login credentials, devices, or account access.

• Use accurate names, contact details, and shipping or pickup information.
• Keep passwords, verification links, devices, and login sessions secure and confidential.
• Do not impersonate any person or create accounts using false or misleading information.

Products, catalog content, and availability

Crestpal offers retail goods, accessories, uniforms, and branding-related services through the website and through physical store locations. Product photos, color representations, sizing guides, descriptions, availability indicators, shipping notes, and promotional copy are provided for general information and merchandising purposes only.

We work to present products accurately, but actual colors, texture, finish, print placement, stitching, packaging, and dimensions may vary based on device display, lighting, supplier changes, production tolerances, material lots, and manufacturing constraints. Product listings, pricing, variants, stock, and fulfillment timelines may change at any time before an order is accepted.

Custom, branded, and quote-based orders

Certain products or services, including uniforms, branded goods, or campaign-related items, may require a quote, quantity confirmation, artwork approval, measurement confirmation, or other manual review before Crestpal accepts the order. A quote, catalog display, chat discussion, or preliminary conversation is not a binding commitment to supply until Crestpal confirms acceptance.

If you submit logos, artwork, names, slogans, designs, or other content for branding or customization, you represent and warrant that you have all necessary rights, permissions, and authority to use that content and to authorize Crestpal to reproduce, adapt, and apply it for the requested work. Crestpal may reject, suspend, or cancel custom work that is unlawful, infringing, misleading, offensive, unsafe, or operationally impracticable.

• Once design approval, production preparation, cutting, printing, embroidery, or other customization work has started, the order may not be cancelled except as Crestpal expressly agrees in writing.
• Minor placement, shade, scale, trimming, and production-tolerance differences are not defects if the finished goods substantially match the approved specifications or commercial standards.
• You agree to indemnify Crestpal against third-party claims arising from branding content, instructions, or materials that you provide.

Orders and order acceptance

Your submission of an order, quote request, coupon, referral code, or payment details is an offer to purchase. Crestpal may accept, reject, limit, split, or cancel an order in whole or in part for reasons including pricing error, stock issues, product restrictions, suspected fraud, payment failure, compliance concerns, courier constraints, or inability to verify customer, address, or order information.

An order is not deemed accepted merely because you receive an automated acknowledgment, cart preview, or payment initiation prompt. Acceptance occurs only when Crestpal confirms the order, processes payment successfully, or otherwise begins fulfillment at our discretion, subject always to stock verification, fraud screening, and operational feasibility.

Pricing, payment, taxes, and promotions

Prices shown on the site may be displayed in one currency while payment is processed in another supported charge currency based on your checkout country, payment method, or processor rules. Crestpal uses Paystack and related channels to process payments, and supported payment methods may include card, mobile money, bank transfer, or other country-specific rails. By initiating payment, you authorize Crestpal and its payment providers to charge the amount confirmed at checkout.

Taxes, duties, levies, shipping fees, currency conversion effects, and third-party charges may apply depending on destination, product type, and payment method. Coupon codes, referral discounts, and promotions are subject to validation, may be revoked for abuse or error, cannot be redeemed for cash, and may be modified or withdrawn prospectively at any time.

Delivery, pickup, title, and risk

Estimated delivery and pickup timelines are targets only and are not guaranteed. Crestpal may use its own fleet, pickup fulfillment, or third-party logistics providers. Delays can occur because of stock reconciliation, customization work, weather, traffic, strikes, customs processing, remote-destination handling, carrier disruptions, force majeure events, or matters outside Crestpal's reasonable control.

Unless applicable law requires otherwise, risk of loss or damage passes to you upon delivery to the address you provided, collection from a Crestpal pickup point, or transfer to the carrier for the final leg of delivery, as applicable. You are responsible for ensuring that shipping and contact information is accurate and that the recipient is available to receive the order.

Returns, refunds, and cancellations

Crestpal operates a strict all-sales-final policy. Except where required by non-excludable law or where Crestpal expressly approves an exception in writing, goods once sold are not returnable, not exchangeable, and not refundable. Change-of-mind requests, sizing preference issues, color preference issues, or delays outside Crestpal's reasonable control do not create a right to return, exchange, or refund.

Customized, branded, made-to-order, altered, discounted, used, worn, washed, damaged, or improperly handled items are not eligible for return or refund except where mandatory law provides otherwise. Your statutory rights, including any non-waivable rights relating to defective goods, misdescription, or unlawful conduct, are not limited by this clause.

Prohibited conduct

You may not misuse the site, interfere with operations, or use Crestpal in a way that creates legal, technical, reputational, or commercial harm.

• Do not attempt unauthorized access, scraping, reverse engineering, denial-of-service activity, malware distribution, or interference with checkout, referral, or account systems.
• Do not use referral codes, coupon logic, promotions, chargebacks, or payment workflows fraudulently, deceptively, or in a manner inconsistent with the stated rules.
• Do not upload or submit unlawful, defamatory, infringing, harmful, or misleading content, including branding assets you do not have authority to use.

Intellectual property

The Crestpal site, storefront design, text, graphics, product copy, branding, software, page layout, compilations, and related content are owned by or licensed to Crestpal and are protected by applicable intellectual property laws. Except as expressly permitted in writing, no content may be copied, reproduced, distributed, modified, or commercially exploited without prior authorization.

Any trademarks, logos, names, and materials you submit remain yours or your licensors' property, but you grant Crestpal a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, process, and display them solely as needed to review, produce, fulfill, support, and document the requested order or service.

Third-party services and external links

Crestpal may rely on third-party service providers and may link to or integrate with third-party sites, platforms, or tools, including payment providers, courier networks, messaging services, mapping tools, email providers, hosting services, analytics services, and social or referral platforms. Those third parties operate under their own terms and privacy practices.

Crestpal is not responsible for third-party acts, omissions, downtime, policies, content, security, availability, or transaction failures except to the extent required by law. Use of third-party services, including off-site links and messaging channels such as WhatsApp, is at your own risk.

Disclaimers

To the fullest extent permitted by law, Crestpal provides the site, content, and services on an as-available and as-permitted basis without guarantees of uninterrupted operation, error-free functionality, specific commercial outcome, universal availability, or absolute security. We do not warrant that the site will always be free from bugs, outages, harmful code, or compatibility limitations.

Except for obligations that cannot lawfully be excluded, Crestpal disclaims implied warranties, conditions, and representations not expressly stated in these terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these terms excludes liability where exclusion is prohibited by law.

Limitation of liability

To the fullest extent permitted by law, Crestpal and its owners, officers, employees, contractors, affiliates, agents, licensors, and service providers will not be liable for any indirect, incidental, special, exemplary, punitive, or consequential loss, including lost profits, lost savings, lost opportunity, lost goodwill, business interruption, data loss, or reputational harm arising out of or related to the site, products, delays, payments, deliveries, referrals, customization work, or these terms.

To the fullest extent permitted by law, Crestpal's total aggregate liability for any claim arising out of or relating to an order or use of the site will not exceed the amount actually paid by you to Crestpal for the specific product or service giving rise to the claim, or if no purchase was made, one hundred Kenya shillings. This limitation applies regardless of the form of action and even if a remedy fails of its essential purpose.

Indemnity

You agree to defend, indemnify, and hold harmless Crestpal and its owners, officers, employees, affiliates, contractors, agents, and service providers from and against claims, liabilities, losses, damages, penalties, judgments, costs, and expenses, including reasonable legal fees, arising out of or related to your breach of these terms, your misuse of the site, your violation of law, your submitted branding content, or your infringement of any third-party rights.

Changes, governing law, and disputes

Crestpal may update these terms from time to time by posting a revised version on the site. The version published at the time of your use or order will apply unless a later version is required by law or expressly accepted by you. Material changes may also be communicated through the site or by other reasonable means.

These terms are governed by the laws of Kenya unless mandatory law in your jurisdiction requires otherwise. Subject to any mandatory consumer rights, the courts of competent jurisdiction in Kenya will have exclusive jurisdiction over disputes arising out of or related to these terms, the site, or any order.
